    Summary of key terms

    • KingdomTix is a ticketing marketplace and technology provider. Event organizers — not KingdomTix — sell the tickets and run the events.

    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and KingdomTix ("Company," "we," "us," or "our") governing your access to and use of the KingdomTix website, mobile applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

    2. Eligibility

    To use our Service, you must:

    • Be at least 18 years old, or the age of majority in your jurisdiction
    • Have the legal capacity to enter into a binding contract
    • Not be prohibited from using the Service under applicable law
    • Provide accurate and complete registration information

    If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

    3. Account Registration

    3.1 Account Creation

    You must create an account to access certain features of our Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

    3.2 Account Security

    You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

    3.3 Account Termination

    We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

    4. Services Description and Our Role as a Marketplace

    4.1 For Event Attendees

    KingdomTix provides a platform for discovering events, purchasing tickets, and managing event attendance. We act solely as a technology provider and limited payment-collection agent for the event organizer.

    4.2 For Event Organizers

    KingdomTix provides tools for creating and managing events, selling tickets, collecting payments through Stripe Connect, managing attendees, and marketing events. Organizers are solely responsible for the events they create, host, price, staff, insure, cancel, reschedule, and refund.

    4.3 KingdomTix Is Not the Seller or Merchant of Record

    KINGDOMTIX IS NOT THE SELLER, PRODUCER, PROMOTER, HOST, VENUE, EMPLOYER, INSURER, OR MERCHANT OF RECORD FOR ANY EVENT OR TICKET. Ticket funds are charged directly to the organizer's own connected Stripe account; KingdomTix does not take custody of ticket proceeds and only receives its disclosed service fee. Every ticket sale is a contract between you and the organizer. We are not a party to that contract and assume none of the organizer's obligations, including any obligation to deliver the event or to issue any refund, credit, exchange, or compensation.

    4.4 No Endorsement or Verification

    Event listings, descriptions, images, prices, and organizer claims are supplied by organizers. We do not verify, endorse, or guarantee the accuracy, legality, safety, quality, religious content, or suitability of any event, organizer, venue, speaker, artist, vendor, or sponsor.

    5. Ticket Purchases

    5.1 Purchase Agreement

    When you purchase a ticket, you enter into a binding agreement with the event organizer. KingdomTix facilitates the transaction as the organizer's limited agent for payment collection and is not responsible for the event itself or for the organizer's performance.

    5.2 Pricing and Fees

    All ticket prices are set by event organizers. A KingdomTix service fee and payment processing fees may apply and are disclosed before you confirm your purchase. Taxes, venue charges, and any other organizer-imposed charges are the organizer's responsibility.

    5.3 Payment Processing

    Payments are processed by Stripe, Inc. through the organizer's connected Stripe account. By making a purchase, you also agree to Stripe's terms. We never receive or store your full payment card information. We are not responsible for outages, holds, reviews, declines, or account actions taken by Stripe, your bank, or your card issuer.

    5.4 Confirmation and Delivery

    Upon successful payment, you will receive an email confirmation with your ticket(s). It is your responsibility to provide a valid email address and to retain your confirmation. We are not responsible for email delivery failures caused by incorrect addresses, spam filtering, or your mail provider.

    5.5 All Sales Final

    UNLESS THE ORGANIZER'S PUBLISHED EVENT POLICY EXPRESSLY STATES OTHERWISE, OR APPLICABLE LAW REQUIRES OTHERWISE, ALL TICKET SALES ARE FINAL AND NON-REFUNDABLE, NON-EXCHANGEABLE, AND NON-TRANSFERABLE.

    6. Refunds, Cancellations, and Chargebacks

    6.1 Refunds Are the Organizer's Sole Responsibility

    ALL REFUNDS, CREDITS, EXCHANGES, AND COMPENSATION ARE THE SOLE AND EXCLUSIVE RESPONSIBILITY OF THE EVENT ORGANIZER. KINGDOMTIX HAS NO OBLIGATION, AND ACCEPTS NO LIABILITY, TO ISSUE OR FUND ANY REFUND OR OTHER PAYMENT TO ANY ATTENDEE UNDER ANY CIRCUMSTANCES, INCLUDING WHERE AN EVENT IS CANCELLED, POSTPONED, RESCHEDULED, RELOCATED, SHORTENED, OVERSOLD, ALTERED, MISREPRESENTED, OR NEVER OCCURS, OR WHERE AN ORGANIZER IS UNRESPONSIVE, INSOLVENT, OR REFUSES TO REFUND. Any refund request must be directed to the organizer.

    6.2 Organizer Refund Policies

    Each organizer sets and publishes its own refund policy on the event page. Please review it before purchasing. Where KingdomTix provides tooling that lets an organizer process a refund, we act only as a technical facilitator executing the organizer's instruction against the organizer's own funds; the decision, the funding, and the legal obligation remain entirely the organizer's.

    6.3 Service Fees Are Non-Refundable

    KingdomTix service fees and third-party payment processing fees are earned when the transaction is completed and are NON-REFUNDABLE, including where the organizer refunds the ticket price or the event does not take place. Nothing in these Terms requires KingdomTix to refund fees from its own funds.

    6.4 Discretionary Action Is Not an Admission

    If KingdomTix ever assists with, facilitates, or voluntarily accommodates a refund (for example, a duplicate charge caused by a verified platform error), it does so as a one-time courtesy at its sole discretion. Such action creates no policy, precedent, course of dealing, waiver, or ongoing obligation, and is not an admission of fault or liability.

    6.5 Organizer Indemnity for Refunds and Chargebacks

    Organizers are financially responsible for all refunds, chargebacks, disputes, reversals, negative balances, and associated fees or penalties arising from their events, and agree to indemnify and reimburse KingdomTix in full for any amount KingdomTix is required to pay, is withheld from KingdomTix, or is charged back to KingdomTix in connection with the organizer's sales. We may withhold, offset, or recover such amounts from any funds or fees otherwise payable to the organizer.

    6.6 Chargebacks

    Because KingdomTix is not the seller, chargebacks relating to a ticket purchase are disputes between you, the organizer, and your card issuer. Fraudulent or bad-faith chargebacks may result in ticket cancellation, account suspension, and collection or legal action. If you have a legitimate dispute, contact the organizer first, and then us, before initiating a chargeback.

    6.7 Force Majeure

    KingdomTix is not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, severe weather, fire, flood, epidemic or pandemic, government action, civil unrest, labor disputes, venue closure, utility or internet failure, cyberattack, or failures of third-party providers such as Stripe or our hosting providers.

    7. Event Organizer Terms

    7.1 Organizer Responsibilities

    As an event organizer, you agree to:

    • Provide accurate event information (date, time, location, description)
    • Deliver the event as advertised or provide appropriate refunds
    • Comply with all applicable laws and regulations
    • Obtain necessary permits, licenses, and insurance
    • Handle attendee data in accordance with applicable privacy laws
    • Respond to attendee inquiries in a timely manner

    7.2 Fees and Payouts

    KingdomTix charges service fees for ticket sales as outlined in our pricing page. Payouts to organizers are processed according to the selected payout tier and schedule. We reserve the right to withhold payouts in cases of suspected fraud or Terms violations.

    7.3 Content Ownership

    You retain ownership of event content you create. By posting content, you grant KingdomTix a non-exclusive, worldwide license to use, display, and distribute your content for platform promotion purposes.

    7.4 Prohibited Events

    You may not use KingdomTix to sell tickets for events that:

    • Violate any law or regulation
    • Promote hate, violence, or discrimination
    • Are fraudulent or misleading
    • Infringe on intellectual property rights
    • Involve illegal substances or activities

    8. Prohibited Conduct

    You agree not to:

    • Violate any applicable law or regulation
    • Infringe on the rights of others
    • Submit false or misleading information
    • Attempt to gain unauthorized access to our systems
    • Interfere with the proper functioning of the Service
    • Use automated means to access the Service without permission
    • Resell tickets in violation of applicable laws
    • Engage in ticket scalping or price gouging
    • Create multiple accounts for fraudulent purposes
    • Harass, abuse, or threaten other users
    • Post spam or unsolicited commercial content

    9. Intellectual Property

    9.1 Our Intellectual Property

    The Service, including its content, features, and functionality, is owned by KingdomTix and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

    9.2 Trademarks

    "KingdomTix" and our logo are trademarks of KingdomTix. You may not use our trademarks without prior written consent.

    10. Disclaimers

    10.1 Service Availability

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

    10.2 Event Disclaimer

    KINGDOMTIX IS A PLATFORM THAT CONNECTS EVENT ORGANIZERS AND ATTENDEES. WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF EVENTS. ATTENDANCE AT ANY EVENT IS AT YOUR OWN RISK.

    10.3 Third-Party Content

    We are not responsible for any third-party content, websites, or services linked to or from our platform.

    11. Assumption of Risk and Release

    You attend events at your own risk. To the maximum extent permitted by law, you release and forever discharge KingdomTix and its affiliates, officers, directors, employees, contractors, and agents from any and all claims, demands, damages, and causes of action of every kind — known or unknown — arising out of or relating to any event, organizer, venue, vendor, sponsor, artist, volunteer, staff member, or other user, including personal injury, illness, death, property damage, theft, event cancellation or change, denial of entry, ticket disputes, and refund disputes.

    If you are a California resident, you expressly waive California Civil Code Section 1542, which reads: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any comparable law of any other jurisdiction.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINGDOMTIX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, ANY EVENT, OR ANY REFUND OR PAYMENT DISPUTE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL SERVICE FEES ACTUALLY RETAINED BY KINGDOMTIX FROM YOUR TRANSACTIONS IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS. TICKET FACE VALUE PAID TO AN ORGANIZER IS NOT AN AMOUNT PAID TO KINGDOMTIX AND IS EXCLUDED FROM THIS CAP.

    Some jurisdictions do not allow certain limitations or exclusions; in those jurisdictions our liability is limited to the greatest extent permitted by law. These limitations are a fundamental basis of the bargain between us.

    13. Indemnification

    You agree to indemnify, defend, and hold harmless KingdomTix and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, fines, refunds, chargebacks, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your events or ticket sales, your content, your violation of these Terms or applicable law, or your violation of any rights of a third party. We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with that defense.

    14. Dispute Resolution and Arbitration

    14.1 Informal Resolution

    Before filing any formal dispute, you agree to contact us at legal@kingdomtix.org with a written description of the claim and to attempt to resolve it informally for at least 30 days.

    14.2 Binding Arbitration

    If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be seated in the State of California and may be conducted by telephone, video, or written submissions where the rules allow. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in small claims court instead.

    14.3 Class Action and Jury Trial Waiver

    YOU AND KINGDOMTIX AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR CLASS-WIDE ARBITRATION.

    14.4 30-Day Opt-Out

    You may opt out of this arbitration agreement by emailing legal@kingdomtix.org within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out. Opting out does not affect any other part of these Terms.

    14.5 Time Limit on Claims

    To the extent permitted by law, any claim relating to the Service must be brought within one (1) year after it arises, or it is permanently barred.

    15. Governing Law

    The proposed governing law is California, United States of America. The specific county, venue, arbitration language, and enforceability of this section require review by qualified counsel before reliance.

    16. Communications Consent

    By creating an account or purchasing a ticket, you consent to receive transactional emails and, where you provide a mobile number and opt in, text messages relating to your orders, tickets, and events. Message and data rates may apply. You can opt out of marketing messages at any time using the unsubscribe link or by replying STOP; transactional messages are required to deliver your tickets.

    17. Copyright and DMCA

    We respect intellectual property rights and respond to sufficiently complete notices. If you believe content on the Service infringes your copyright, send a notice with the required elements to copyright@kingdomtix.org. We may restrict repeat infringers' accounts as appropriate.

    18. Assignment, Waiver, and Survival

    You may not assign these Terms without our written consent; we may assign them freely, including in a merger or sale of assets. Our failure to enforce any provision is not a waiver. Sections on refunds, disclaimers, release, limitation of liability, indemnification, dispute resolution, and governing law survive termination of your account or these Terms.

    19. Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

    20. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

    21. Entire Agreement

    These Terms, together with our Privacy Policy, Cookie Policy, and any organizer or event-specific policies published on the Service, constitute the entire agreement between you and KingdomTix regarding the Service.
